These Terms of Service ("Terms") govern your use of the products and services provided by WaySky Technologies LLC ("WaySky," "we," "us"). By using our services, you agree to these Terms.

1. What we provide

A free portal that tracks how your company appears in AI-generated recommendations.
A paid Reality Check evaluation with a readiness score and prioritized actions.
A paid Fix Pack: done-for-you proof pages, positioning, and comparison content.
A paid Source Sprint: facilitated credible third-party coverage (reviews, evaluations, listicles).

2. No guarantees

We do not and cannot guarantee that any AI model will recommend, mention, or rank your product.
AI outputs are non-deterministic and change over time without notice.
Our portal data is directional, not exact. Missed demand estimates are proxies, not precise usage figures.
Past results do not guarantee future performance.

3. Mini audit limitations

The mini audit is generated by a third-party AI model (OpenAI). WaySky does not control or guarantee the accuracy of the output.
The audit is for informational purposes only and does not constitute professional advice.

You should independently verify any claims or recommendations before acting on them.

4. Disclosures and publisher integrity

Where WaySky facilitates third-party coverage, we require clear disclosure of the commercial relationship.
We pay for evaluation time, not for positive opinions. All reviews and evaluations must be honest.
Publishers retain editorial independence. We do not control what they write.

5. Eligibility / readiness gate

Before facilitating any Source Sprint coverage, your product must clear a readiness threshold based on our independent evaluation. If you do not meet the threshold, we will recommend Fix Pack work first and explain what needs to change.

6. Payments, refunds, and chargebacks

All paid services require upfront payment unless otherwise agreed in writing.
Refunds are considered on a case-by-case basis for undelivered work. Delivered work is non-refundable.
If you initiate a chargeback for delivered services, we reserve the right to suspend your account and pursue the disputed amount.
The free portal may be discontinued or modified at any time without notice.

7. Customer responsibilities

You must provide accurate information about your company and product.
You are responsible for publishing any deliverables we create (we provide drafts; you approve and deploy).
You agree not to misrepresent WaySky's services or claim guaranteed AI recommendations in your own marketing.

8. Intellectual property

Deliverables created for you (Fix Pack content, comparison pages, etc.) are yours to use once paid in full.
Our portal, methodology, scoring frameworks, and internal tools remain WaySky's intellectual property.
You may not resell, sublicense, or redistribute our tools or portal access.

9. Limitation of liability

WaySky's total liability for any claim arising from these Terms or our services is limited to the amount you paid us in the 12 months preceding the claim.
We are not liable for indirect, incidental, consequential, or punitive damages, including lost revenue, lost profits, or lost data.

10. Indemnification

You agree to indemnify WaySky against claims arising from your use of our deliverables.
You agree to indemnify WaySky against claims arising from content you publish based on our recommendations.
You agree to indemnify WaySky against claims arising from your misrepresentation of our services.

11. Termination

Either party may terminate the relationship at any time. If you have a paid engagement in progress, termination terms will be governed by the applicable statement of work or engagement letter. Free portal access may be revoked at our discretion.

12. Governing law and venue

These Terms are governed by the laws of the State of Florida. Any disputes will be resolved in the state or federal courts located in Florida.

13. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice on our website. Continued use of our services after changes constitutes acceptance of the updated Terms.
